Wrongful Death Claim Filed Against the State

Chico, CA – Attorney Stewart Galbraith, a partner with Penney & Associates in Chico, recently filed a formal wrongful death claim against the State of California arising from the death of his client’s 15 year-old son Weston Sites.

According to the filed claim, Weston was fatally injured on June 7, 2016 in a motor vehicle collision allegedly caused by on-duty CHP Officer James Gamble. Weston was the back seat passenger in a 2013 Hyundai traveling northbound on Interstate 5 near Orland, in Glenn County. Due to stopped traffic ahead, the driver of the Hyundai brought her vehicle to a complete stop.

Meanwhile, Officer Gamble was operating a marked CHP mobile road enforcement pick-up truck directly behind the Hyundai. Attorney Galbraith alleges that Officer Gamble failed to observe the stopped traffic ahead because he was looking at his on-board computer.

As a result of this alleged “distracted driving,” the large CHP pickup truck slammed into the rear of the stopped Hyundai, causing fatal injuries to Weston Sites, who had just finished his freshman year at Willows High School. Mr. Galbraith of Penney & Associates represents Weston’s father Byron Sites.

Update (04/17/2017): On April 10, 2017, Attorney Stewart Galbraith of Penney & Associates, and his client Byron Sites, participated in a lengthy mediation hearing with the legal representatives of the California Highway Patrol, resulting in a settlement of Mr. Sites’ claim for the wrongful death of his son.
